1. Acceptance of Terms

By accessing or using the Pxcribe platform, medical scribe services, or EMR software, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use immediately.

2. Service Description

Pxcribe provides an AI-powered medical transcription and clinic management tool. While our AI achieves high accuracy, it is a tool meant to assist healthcare professionals. **The final clinical responsibility for every prescription and note remains with the registered medical practitioner.**

3. User Responsibilities

• You must provide accurate professional registration details.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must obtain patient consent where necessary for clinical audio recording and data entry.

4. Limitation of Liability

Pxcribe shall not be held liable for any clinical errors made by medical staff using the software. Our services are provided "as-is" and "as-available" without any warranties of merchantability or fitness for a particular purpose.

5. Pricing & Subscription

Pxcribe operates on a three-tiered pricing structure, detailed below:

• Free Starter: ₹0/forever. Limited to 20 AI Smart Consults and 50 Appointments per day. Includes full software access on existing phones, tablets, or laptops.
• Software (Pay As You Go): Billed at ₹2.00 per patient up to 50 patients per day. Usage exceeding 50 patients per day is billed at a reduced rate of ₹1.50 per patient. Requires pre-paid wallet balance.
• Software (Unlimited): Flat fee of ₹2,100 per month for unlimited usage of all software features without per-patient caps.
• Pxcribe360: Billed at ₹5.00 per patient. Includes the Pxcribe software, a dedicated tablet, thermal printer, and studio microphone. Condition: A monthly limit of ₹4,500 applies. However, a strict cap of 100 patients per day exists. For every patient seen beyond the 100th patient on any single day, an overage charge of ₹5 per patient will be applied, which is excluded from and added on top of the ₹4,500 monthly limit. Requires waitlist approval and security deposit.

6. Hardware Liability & Security Deposits

For the "Fully Pxcribe" plan, a security deposit is required subject to the value of the issued hardware products (tablets, printers, etc.). By accepting the hardware, the issuing doctor assumes full responsibility for the devices.

In the event of damage, loss, or theft of the hardware products, the doctor is held entirely liable. Damages will first be recovered from the security deposit. If the cost of the damage exceeds the security deposit, the excess amount will be legally recovered directly from the issuing doctor in accordance with the provisions of The Indian Contract Act, 1872, and other applicable Indian laws.

7. Jurisdiction

These terms are governed by the laws of India. Any disputes arising out of these terms, software usage, or hardware liability shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
